Technology Today: Authenticating Social Media Evidence

Litigation partners H. Christopher Boehning and Daniel J. Toal authored an article that discusses the evidentiary potential of social media sites and the peculiar challenges of authenticating materials from such sources. The authors examine social media's increasing role in federal and state court decisions in cases ranging from trademark infringement, to sexual harassment, to worker's compensation. In these cases, the authors suggest carefully documenting the process of data gathering and the use of sophisticated software, where necessary, to ensure that the discovery results are not excluded from evidence due to a failure of authentication. The article, "Authenticating Social Media Evidence" appeared in the "Technology Today" section of the October 2 issue of the New York Law Journal.
