Litigation partner Les Fagen and associates Darren Johnson and Hallie Goldblatt published an article entitled "Paying to Play" in yesterday's issue of the Los Angeles Daily Journal. The article examines the impact of the recent verdict in Capitol Records, et al. v. Thomas, the first copyright infringement case against an individual file-sharing service user to go to trial and final judgment. The article discusses the implications of the $222,000 damages award, and the significance of the court's ruling that a music copyright owner need only show that a user "made available" copyrighted songs over a file-sharing network in order to prove a violation of the copyright owner's exclusive right of distribution under the Copyright Act.
