Litigation partner Lew Clayton's Intellectual Property Litigation column appeared in the July 13 issue of the New York Law Journal. The article discusses Barclay's Capital Inc. v. Theflyonthewall.com Inc., where the Second Circuit Court of Appeals held that a misappropriation claim filed by investment banks whose confidential research reports were publicized by a web site was preempted under the Copyright Act.
