Paul, Weiss Achieves Victory for Edwards Lifesciences in Patent Litigation
As reported in The American Lawyer, Bloomberg News, Dow Jones and Reuters, on April 1, 2010, a federal court jury awarded Paul, Weiss client Edwards Lifesciences $74 million after it found that the Medtronic CoreValve ReValving system infringed Edwards' transcatheter heart valve patent. The invention permits a defective heart valve to be replaced with an artificial heart valve using a catheter, thus eliminating the need for open heart surgery.
The jury found the infringement to be willful, which allows Edwards to seek enhanced damages of up to three times the jury award for past infringement. In addition, Edwards will move for an injunction prohibiting future manufacture and sale of the infringing ReValving system in the United States.
