Litigation partners Chris Boehning and Dan Toal's e-discovery article was published in the August 26 issue of the New York Law Journal. The article, "Reasonable Expectations of Privacy Expand," discusses the continual re-examination by the courts of the extent to which employees have a reasonable expectation of privacy when using office equipment to surf the Internet, send e-mail and transmit text messages for personal reasons. The U.S. Court of Appeals for the Ninth Circuit's recent decision in Quon v. Arch Wireless Operating Co. Inc. demonstrates the fragility of judicial consensus on this subject and the need to stay abreast of new developments.
