Litigation partners Chris Boehning and Dan Toal published an article titled, "Overcoming Evidentiary Hurdles," in the October 23 issue of the New York Law Journal. The article notes that although much attention has been devoted to the recent revisions to the Federal Rules of Civil Procedure relating to the discovery and production of electronically stored information, litigants frequently overlook the evidentiary obstacles to using this electronic evidence in court. The authors discuss various methods for securing the admission of electronically stored evidence. Litigation associate Josh Kaye assisted in the preparation of the article.
