A partner in the Litigation Department, Emily Vance represents clients in complex litigation and internal investigations with a particular focus on employment-related litigations and workplace investigations. In her employment practice, she has handled matters concerning a wide variety of workplace issues, including harassment, discrimination, employment policy violations, compliance issues and the disclosure of trade secrets. Emily also has experience representing clients in complex civil and criminal litigation, at both the trial and appellate levels, as well as government investigations and regulatory enforcement actions.

EXPERIENCE

Emily has represented major public companies, higher education institutions and private equity firms in connection with employment-related litigations and workplace investigations. She has litigated significant civil and criminal cases in state and federal courts across the country, and has represented clients before the Equal Employment Opportunity Commission (EEOC) and the New York State Division of Human Rights. Among others, Emily’s recent employment-related matters include representing:

  • Pfizer in securing the denial of a preliminary injunction and dismissal of a high-profile “reverse discrimination” suit alleging that Pfizer’s Breakthrough Fellowship Program, designed to enhance Pfizer’s pipeline of diverse leaders, violates Section 1981, Title VI of the Civil Rights Act, the Affordable Care Act, and various New York State and New York City human rights laws;
  • The New York Presbyterian Hospital in litigation and other matters regarding COVID-19 vaccine mandates, notably defeating multiple requests for injunctive relief and in winning a significant Second Circuit appeal, which Emily argued;
  • Legal tech company CS Disco in a review of the company’s workplace policies and procedures following the resignation of its founder and former CEO;
  • The Regents of the University of California and UCLA Health in securing the dismissal of a lawsuit brought in Los Angeles County Superior Court brought by former patients of a former physician at UCLA Health alleging inappropriate touching and sexual assault and claiming that the UC Health system was vicariously liable due to negligence;
  • A global technology company in a sensitive internal investigation of its wholly owned subsidiary regarding internal hotline complaints against senior leadership involving allegations of retaliation, bullying, bypassing procurement policies, conflicts of interest, and cultural issues related to company vaccine mandates; and
  • A healthcare system in connection with internal and law enforcement investigations related to allegations of inappropriate conduct by hospital physicians.

Emily also regularly handles complex commercial disputes, white collar defense and regulatory enforcement matters for clients across the technology, media, healthcare and manufacturing industries. She has successfully defended clients in high-stakes breach of contract litigations, IP and trade secrets disputes, and securities and antitrust litigation. She has also represented clients in investigations and enforcement actions by the Department of Justice, the Securities and Exchange Commission, state attorneys general and other federal and state regulators. Emily’s recent notable matters include representing:

  • Snap, Inc. and several of its directors and executives in the resolution of a securities class action brought by investors in connection with the company’s $3.4 billion IPO in 2017;
  • World Wrestling Entertainment (WWE) in a breach of contract and IP infringement suit seeking emergency injunctive relief against Panini S.p.A. related to Panini ’s use of WWE’s IP on trading cards, stickers and games;
  • A major Japanese bank in negotiating a favorable settlement and dismissal with prejudice in a putative antitrust class action brought on behalf of purchasers of foreign exchange instruments asserting claims under the Sherman Antitrust Act and the Commodity Exchange Act;
  • A global flooring manufacturer in responding to SEC subpoenas for documents and testimony stemming from an SEC inquiry into potential earnings management. Emily and the Paul, Weiss team negotiated the resolution of this investigation and subsequently represented the company in a private securities action, which settled favorably;
  • A prominent hospital in a consumer privacy investigation by the NYAG; and
  • A former employee of a currency exchange business in an Eleventh Circuit appeal of a criminal conviction for mail fraud, wire fraud and making false statements to federal agents.

Emily maintains an active pro bono practice focused on disability rights, prisoners’ rights and criminal defense. She achieved a victory in New Jersey state court on behalf of a pro bono client in an appeal of a criminal conviction charge.

In addition, Emily has worked as an adjunct professor of legal writing at Fordham University School of Law and serves as a junior board member at Family Legal Care.
