A counsel in the Litigation Department and member of the Employment Law, Workplace Investigations & Trade Secrets Litigation practice group, Aubrey Smith focuses his practice on labor and employment litigation, investigations and counseling. He regularly represents clients across a wide range of employment issues, including in non-compete litigations, claims under ERISA, employment class and collective actions and individual claims. Aubrey also regularly counsels clients on employment-related issues including compliance with federal, state and local employment statutes.
EXPERIENCE
Aubrey has significant experience representing clients in class and collective actions concerning wage and hour and employment discrimination claims, as well as individual employment claims involving wrongful termination, harassment, discrimination, retaliation and wage and hour violations. He has notably provided extensive counseling services to professional services firms and financial institutions regarding employment issues ranging from addressing challenges to non-compete restrictions and other restrictive covenant issues, to negotiating separation agreements and advising on various employment-focused compliance issues.
Aubrey has extensive experience leading workplace investigations in connection with a wide-range of employment issues, including misappropriation of trade secrets, allegations of unlawful discrimination and retaliation, and breach of non-competition restrictions.
Aubrey also has experience in ERISA litigations, including representing clients in claims under ERISA Section 502 for denial of benefits and breach of fiduciary duties, and claims under Section 510 for interference with vesting rights.
Aubrey was previously an honors attorney with the U.S. Department of Transportation (DOT) where he successfully represented the DOT in multiple employment discrimination cases before the U.S. Equal Employment Opportunity Commission, Office of Federal Operations.
Aubrey is a member of the Duke Law Alumni Association Board of Directors and the Labor & Employment Law Section of the New York State Bar Association. Aubrey was included in the 2023 edition of the Best Lawyers: Ones to Watch in America in the areas of Labor and Employment Law, Management and Litigation, and Labor and Employment.
