Jeremy Veit and Austin Pollet Discuss Opportunities for Private Equity General Counsel in Challenging Market in The Recorder

Corporate partners Jeremy Veit and Austin Pollet wrote an article published in The Recorder on the important role general counsel at private equity firms can play in navigating the current deal market and identifying opportunities to create value. In the article, “Succeeding in a Challenging Market: What Private Equity GCs Should Focus on in 2023,” published on February 1, the authors discuss how GCs can take advantage of the changing transactional playbook, including how to bridge valuation gaps, leverage seller financing and institute due diligence best practices. With dealmaking moving more slowly, private equity firms and their GCs can spend more time assessing ESG and regulatory approaches and reevaluating portfolio company management.

Jeremy and Austin note that opportunistic private equity firms have historically delivered strong returns for their investors during past economic crises. “With the right guidance from their in-house and outside counsel, private equity firms will be well-positioned to… do what they do best: identify excellent opportunities and set their portfolio companies up for success,” the authors say.
