Litigation partner Kannon Shanmugam and associates Jamie Durling and Anna Stapleton were recognized in The American Lawyer’s March 7 “Litigation Daily” column for overturning a $26 million jury verdict in a breach of contract case against audiovisual and multimedia company Cypress Technology Co. On appeal before the Ninth Circuit, we argued, among other things, that the district court erred because the question of whether an exclusive business management agreement between Cypress and plaintiff OWLink Technology had been validly terminated was a pure question of contract interpretation that should have been resolved as a matter of law instead of submitted to the jury.
