In the February 25 edition of its “DealBook” newsletter, The New York Times cited an article written by litigation counsel Bob Kravitz. The newsletter, “Is It Fraud, or Is It ‘Puffery’?” discusses examples of how U.S. courts have applied the legal defense of “puffery,” or vague expressions of corporate optimism—and links to Bob’s article, “Room for Optimism: The ‘Puffery’ Defense under the Federal Securities Laws,” originally published in the American Bar Association’s Securities Litigation Journal in 2009. Bob’s article discusses the puffery defense in the context of securities lawsuits, and offers a comprehensive survey of all circuit court decisions on puffery up to that point.
