Litigation partners Bob Atkins, Bill Michael and Jacqui Rubin were recognized in The American Lawyer’s “Litigation Daily” for their victory in an antitrust class action against Becton, Dickinson and Company (BD) brought on behalf of a putative class of all U.S. hospitals and healthcare providers. Leading BD’s defense, the Paul, Weiss partners won the complete dismissal, with prejudice, of a lawsuit alleging that BD conspired with distributors of its products to inflate the prices of syringes and IV catheters by excluding competitors from the market. Judge Nancy J. Rosenstengel in the Southern District of Illinois granted BD’s motion to dismiss, finding that the plaintiffs’ conspiracy claim was “implausible on its face.” Bill argued the motion to dismiss. The Paul, Weiss team also included litigation counsel Daniel Crane.
The article also noted that Bob was previously recognized as “Litigator of the Week” for his trial and appellate victories in a lawsuit involving similar allegations brought by BD’s competitor Retractable Technologies, Inc.
